Terms of Service

1. Acceptance of Terms

By accessing or using Punch ("the Service"), operated by CF Innovation Labs ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Punch is an AI-powered social media automation platform that generates, schedules, and publishes content to connected social media accounts on your behalf. The Service uses artificial intelligence to create text and images.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old to use the Service.
• One person or legal entity may maintain multiple accounts (one per company/brand).

4. Acceptable Use

You agree NOT to use the Service to:

• Generate or publish illegal, harmful, threatening, abusive, or hateful content.
• Impersonate any person or entity.
• Violate the terms of service of any connected social media platform.
• Send spam or unsolicited messages.
• Distribute malware or engage in phishing.
• Attempt to reverse engineer, hack, or disrupt the Service.

5. AI-Generated Content

• Content generated by the Service is created by AI and may contain inaccuracies.
• You are solely responsible for reviewing and approving all content before publication.
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
• You retain ownership of content generated through your use of the Service.

6. Credits and Payments

• The Service operates on a credit-based system. Credits are consumed when generating content or images.
• Payments are processed by Lemon Squeezy (our Merchant of Record). Their terms apply to all transactions.
• Credits are non-refundable once consumed. Unused credit balances may be refunded upon request within 30 days of purchase.
• We reserve the right to modify pricing with 30 days' notice.

7. Connected Platforms

• By connecting your social media accounts, you authorize us to publish content on your behalf.
• You are responsible for complying with each platform's terms of service.
• We are not responsible for actions taken by third-party platforms (account suspension, content removal, etc.).
• You may disconnect any platform at any time.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform maintenance with or without prior notice.
• We are not liable for any losses resulting from service downtime.

10. Limitation of Liability

To the maximum extent permitted by law, CF Innovation Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

11. Account Termination

• You may delete your account at any time from the Settings page.
• We may suspend or terminate accounts that violate these terms.
• Upon account deletion, your data will be permanently removed within 30 days.

12. Changes to Terms

We may update these terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Berlin, Germany.
